Terms and Conditions

• All goods and services supplied by Blue Fox UK Ltd are on the understanding that customers are fully aware and agree to the following terms and conditions.

Delivery

• All goods are delivered subject to availability. Every effort is made to despatch goods confirmed before 3.00pm on the said delivery date. Blue Fox UK Ltd will accept no liability for delays or damages due to circumstances beyond our control. After delivery the goods are the buyers responsibility, however ownership of goods remains as outlined below.
• Delivery outside of the U.K. mainland is by arrangement only.

Ownership of Goods

• All goods will remain the property of Blue Fox UK Ltd until payment is made in full. Therefore, the buyer may not sell, transfer, assign or dispose of any goods other than in normal course of business. If goods are sold or otherwise disposed of that have not been paid for then it is agreed that the customers liability to Blue Fox UK Limited will remain and in the event of the customers going into receivership, liquidation, insolvency or being declared bankrupt, Blue Fox UK Limited will rank as a preferential creditor in respect of moneys owed to Blue Fox UK Limited for goods sold or otherwise disposed of by the customer.
  
• Unsold goods remain the property of Blue Fox UK Limited and the customer agrees to notify Blue Fox UK Limited within seven days of going into receivership, liquidation, insolvency or being declared bankrupt, and allow Blue Fox UK Ltd all necessary facilities to obtain, collect or retrieve any goods not paid for.

Payment

• The full balance or a Bankers draft is required in advance if a credit facility has not been obtained.
  
• Responsibility for payment rests with the customer unless Blue Fox UK Ltd are informed in writing of any shortages, damages or a non-delivery within 7 days from invoice date.
  
• Goods made outside the UK, are subject to pro-forma payment terms, unless otherwise agreed in writing.
  
• Goods will not be despatched on overdue accounts.
  
• Blue Fox UK Ltd reserves the right to apply interest at the rate of 1% per month, on accounts and invoices that are not settled within our terms of trading. Admin charges will also apply at the rate of £20 per correspondence.
  
• Returned or represented cheques will be charged at £20.00 per representation.

Prices

• All prices are excluding V.A.T. Prices are subject to availability.
  
• Blue Fox UK Ltd reserves the right to alter prices without prior notification.

Returned Goods

• Goods may not be returned without prior authorisation and may not be sold on a "sale or return" basis.
  
• Only faulty goods that have NOT been worn and are returned within a 3 month period after accepting delivery will be credited in full.
  
• Goods returned due to customer error, will be subject to a 10% administration charge.
  
• The purchaser is responsible to ensure goods are satisfactory when despatching to a third party.

Responsibility

• Blue Fox UK Ltd will not accept responsibility for any variation in shade, material or composition shown within our current catalogue.

Custom Designed Products

• The minimum quantity for custom design orders is 300 pieces.
  
• A deposit of 30% of total order is required, 30% payment on delivery, and the remaining 40% net 14 days unless otherwise agreed in writing.
  
• Once customer orders have been confirmed in writing they cannot be cancelled and must be paid in full.

Copyright

• In acceptance of artwork Blue Fox UK Ltd assumes the customer is a copyright holder, or an authorised user licensed by the copyright holder and will indemnify Blue Fox UK Ltd against any infringement of copyright law that may arise. Written proof must be submitted.
  
• Blue Fox UK Ltd solely holds all copyrights on any new artwork they produce.
  
• Designs produced by Blue Fox UK cannot be reproduced by the client, or any third party without first receiving written consent, from Blue Fox UK Ltd.

Quantities

• Blue Fox UK Ltd reserves the right on all custom design orders to deliver 10% above or below the actual quantity without prior notification.
  

Samples

• Once requested, all sample items are non-refundable, and must be paid in full unless a prior agreement has been made.

Acceptance of Goods

• A customer who accepts delivery of goods is deemed to accept all clauses in this document whether the goods are signed for or not.

Jurisdiction

• All contracts between Blue Fox UK Ltd and the buyer will be administered by English laws, any disputes that may arise will settled in the English courts alone.
